License Agreement
This license agreement (the “Agreement”) is a legal agreement between you and the author of MobileVNC Server (Wolfgang Beer). The Agreement covers the use of the program called MobileVNC Server (refered to as ‘the program’) for Windows CE and PocketPC devices. By installing or otherwise using the program, you agree to be bound by the terms of this Agreement.
If you do not agree to the terms of this Agreement, MobileVNC Server will not be licensed to you.
In such event, do not install or download the program.
1. GRANT OF LICENCE
Subject to the terms of this Agreement, MobileVNC Server grants you a license of the following rights:
(a) The exclusive and limited right to use one copy of the program
(b) The right to make a single back-up copy of the program. (You may use the back-up copy solely for
back-up and archival purposes.)
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
In addition to the general terms of the license set out under Section 1 above,
below are set out the following specific rights and limitations of the license:
(a) Limitations on Reverse Engineering, Decompilation and Dissassembly
You may not reverse engineer, decompile, or disassemble the MobileVNC Server program,
The author will terminate this Agreement if you attempt or have attempted to reverse engineer,
decompile, or disassemble the program in breach of this provision.
(b) Rental
You may not rent or lease the program.
(c) Redistribution
You may not sell, give or distribute the program or copies of it to any person.
(d) Transfer of Rights
You may not transfer any of your rights or obligations under this Agreement to any other person.
(e) Termination
This Agreement lasts until you terminate it by destroying all copies of the program
If you fail to comply with the conditions of the Agreement then the author will terminate
this Agreement and you will be required, by the terms and conditions of this Agreement,
to destroy all copies of the program. The author may also terminate this Agreement immediately
on notice for any reason.
3. INTELLECTUAL PROPERTY RIGHTS
3.1 All title, copyright, all other intellectual property rights in and to the program
are variously owned by the author, Dr. Wolfgang Beer, Schwalbenweg 17, 4540 Bad Hall, Austria.
3.2 All rights not specifically granted under this agreement are reserved by the author.
You agree to inform any recipient of an application that no intellectual property rights
in the program are transferred to the recipient.
4. DISCLAIMER OF WARRANTY
4.1 The author shall not be responsible for any loss or damage (whether direct or indirect),
howsoever arising in connection with the subject matter of this agreement.
The author shall not be liable for any loss of revenues, loss of profits, loss of money,
loss of or damage to goodwill or loss of anticipated savings, or (without limitation)
for any indirect, special or consequential damages, even if MobileVNC Server has been advised of the
possibility of such damages.
4.2 The author delivers MobileVNC Server “as is, where is” without warranty of any kind.
4.3 The author of PocketVNC Server is not responsible for any illigal usage of the program.
5. ENTIRE AGREEMENT AND AMENDMENTS
5.1 This agreement constitutes the entire agreement and understanding between the parties
with respect to its subject matter. No representation, undertaking or promise shall
be taken to have been given or implied from anything said or written in negotiations
between the parties prior to this agreement except as stated in this agreement.
5.2 No amendments, changes or revisions or discharges of this Agreement, in whole or in part,
shall have any force or effect except by written agreement between the parties.
6. GOVERNING LAW AND DISPUTES
6.1 This agreement shall be governed by and construed and enforced in accordance
with the laws of Austria, without respect to its provisions on conflict of laws.
6.2 Any dispute or controversy which may arise out of or in connection with this agreement
shall be submitted to the exclusive jurisdiction of the courts of Austria.
